Individual charged with fraud over unauthorised investment scheme

The Financial Conduct Authority (FCA) has launched criminal proceedings against Guy Flintham for committing fraud by false representation and for carrying out regulated activity without authorisation.

In a recent development, the Financial Conduct Authority (FCA) has initiated criminal proceedings against Guy Flintham, a Blackburn-based individual, on charges of fraud by false representation and conducting regulated activities without proper authorization.

According to the FCA’s allegations spanning from January 2016 to November 2021, Mr. Flintham purportedly deceived approximately 240 investors, amassing £19 million through an investment scheme he operated. His modus operandi involved fabricating representations to entice investors, including misleading claims about the scheme’s operation and promised profits, supported by falsified documentation.

Moreover, Mr. Flintham’s acceptance of funds from investors constituted the regulated activity of accepting deposits, a function for which he lacked proper authorization. Consequently, the FCA asserts that Mr. Flintham, as an unauthorized individual, violated laws governing regulated activities.

The legal proceedings commenced with Mr. Flintham’s appearance at Westminster Magistrates’ Court on 22 January 2024, during which he entered a plea of Not Guilty concerning the offence of conducting regulated activities without authorization. However, he did not indicate a plea regarding the fraud charge. The case has since been transferred to Southwark Crown Court for a Plea and Trial Preparation Hearing scheduled for 19 February 2024.
